In 1995, the Procter & Gamble Company and the Procter & Gamble Distributing Company (hereinafter jointly referred to in the singular as P&G) filed this action against the Amway Corporation (Amway) and certain of its distributors asserting claims under Section 43(a) of the Lanham Act, 15 U.S.C. § 1125(a), and Utah common law. The district courts subject matter jurisdiction was based on 28 U.S.C. §Â§ 1331, 1332, and 1367. In March 1999, the district court granted summary judgment to defendants on some of P&Gs claims and dismissed the remaining claims. P&G appealed and, in August 2000, this court reinstated the Lanham Act and tortious interference claims and remanded the case for further proceedings. Procter & Gamble Co. v. Haugen, 222 F.3d 1262, 1280 (10th Cir. 2000). In June 2001, the district court dismissed all claims against Amway and granted partial summary judgment in favor of the distributor defendants with respect to P&Gs tortious interference claim. P&G again appealed, and this court affirmed the district courts dispositive rulings, thereby leaving only P&Gs Lanham Act claim against the distributor defendants to be litigated. Procter & Gamble Co. v. Haugen, 317 F.3d 1121 (10th Cir. 2003).
